Advertising in company emails

BGH , judgment - VI ZR 134/15, 16.12.2015

There are many ideas for advertising. However, personal enthusiasm for an idea on how to advertise should be well thought out, especially in connection with electronic media:

Companies are not allowed to send unsolicited advertising in email correspondence with their customers. In a ruling published on 16.12.2015, the Federal Court of Justice ruled in favor of a man from the Swabian town of Göppingen who had received advertising in the credits of an automatically generated confirmation of receipt and imposed hefty penalties on companies that did not comply (case reference: VI ZR 134/15).

Fines of up to 250,000 euros are to be imposed.
